These terms and conditions are applied and an integral part of any contract of sale unless otherwise agreed between the parties forming it.
Shipping in charge of the customer buyer, any risk or damage to goods will be assumed by him.
Shipping which is the responsibility of TECNOPOL SISTEMAS SLU, risk and damage of goods, are assumed provide the following
clauses:
Cracks, dents and defects observed during delivery time, shall be notified to the transport company before goods accepting and communicated in writing to TECNOPOL SISTEMAS SLU before 24h.
The delay in supplies behaves no compensation of any kind, either cancel the order once loaded the transport company.
Returns will not be accepted unless previously agreed. All returns must be accepted by the company after product checking. The material and the product must be in perfect conditions. In any case, the customer must pay 10% of the value of the product delivered as regard unpacking and / or stock. It not will be accepted any material after one month from its delivery.
In the event of non-conforming delivery, any complaint, whether it concerns the quantity or the quality of the materials sold, must be made in writing within 24 hours.
Any tax or excise, of whatever nature, imposed on business operations and will be the responsibility of the buyer, although they were eventually required the seller.
The amounts specified in this price list are all Ex Works
The shipping always will be assumed by the buyer.
For any legal matter arising from the sale or derived therefrom, the parties expressly submit to Barcelona Courts expressly waiving any other court.
TECNOFLOOR: Special colorations at no additional cost for orders over 350 kg. For orders less than that, the PIGMENTS EP pigment is billed separately.
TECNOTOP 1C: For orders over 200 kg, we offer special colorations and the product is delivered already pigmented,
at no additional cost.
TECNOTOP 2C/2CP: Special colorations at no additional cost for orders over 340 kg. For orders less than that, the PIGMENTS PU pigment is billed separately.
TECNOTOP S-3000: Special colorations at no additional cost for orders over 440 kg. For orders less than that, the PIGMENTS PU pigment is billed separately.
If not covered by these Sale Conditions, and subject to the following clause, TECNOPOL SISTEMAS SLU does not accept any liability beyond the remedies set forth herein, including but not limited to any liability for goods not being available for use, lost of profits or revenue or loss of business. Except as expressly provided herein, TECNOPOL SISTEMAS SLU will not be liable for any consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party.
The buyer of goods agrees that for any liability related to the purchase of goods, which shall be exclusively determined according to the above, TECNOPOL SISTEMAS SLU is not liable or responsible for any amount of damages above the amount of the relevant order, which shall be considered a maximum cap for all applicable concepts.
Notwithstanding the above, nothing in these Sale Conditions shall limit or exclude TECNOPOL SISTEMAS SLU liability (i) for death or personal injury caused by gross negligence of TECNOPOL SISTEMAS SLU, (ii) for fraud or (iii) any liability which cannot be excluded by law.
The remedies set forth in these Sale Conditions will be the buyer’s sole and exclusive remedy for any claim against TECNOPOL SISTEMAS SLU under or related to these Sale Conditions.
Additional Notes:
VAT or other taxes are not included in this price list.
This price list cancels any other previously issued.

The delivery times shall be defined from time to time, depending on the model, location and shipping type.
